This website(s)/application(s)/service(s) is/are operated/provided by JHA INFO SOLUTIONS ("ReeCab").

These terms and conditions ("User Terms") apply to Your visit to and use of the Site/Mobile App whether through a computer or a mobile phone, the Service and the Application, as well as to all information, recommendations, and or services provided to You on or through the Site, and the Application. This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the provisions on electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

By clicking on the "I ACCEPT" button or by using ReeCab's services, You are acknowledging and consenting to be bound by these User Terms. PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE USER TERMS BEFORE YOU USE THE SITE. If You do not wish to accept any of the User Terms, then please do not use the Site or avail of any of the services being provided therein. YOUR AGREEMENT TO THESE USER TERMS SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND REECAB IN RESPECT OF THE USE AND SERVICES OF THE SITE. Your access and use of the Services constitute your agreement to be bound by these Terms, which establishes a contractual relationship between you and REECAB. These terms expressly supersede prior agreements or arrangements with you. REECAB may immediately terminate these Terms or any Services concerning you, or generally, cease offering or deny access to the Services or any portion thereof, at any time for any reason. Supplemental terms may apply to certain Services, such as policies for a particular event, activity, or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to and shall be deemed a part of, the Terms for the purposes of the applicable Services.

Your acceptance of the User Terms shall be deemed to include your acceptance of the privacy policy. By accepting these User Terms, You also allow REECAB to send you promotional emails and SMS alerts from time to time.

IT IS HEREBY EXPRESSLY CLARIFIED THAT THESE USER TERMS WILL NOT APPLY TO CORPORATE ENTITIES THAT ARE GOVERNED BY THE REECAB CORPORATE TERMS OF USE. HOWEVER, ALL AUTHORIZED USERS TAKING 'REECAB CORPORATE RIDES' I.E., FOR CUSTOMERS WHO ARE AVAILING RIDES UNDER THE DIRECT ARRANGEMENTS BETWEEN CORPORATE ENTITIES AND REECAB SHALL ALSO BE GOVERNED BY this USER TERMS.

1. TAXI

1.1. ROLE OF REECAB

1.1.1. ReeCab only provides a technology platform that connects intending travelers with Taxi/Cab operators. It doesn’t operate any Taxi/Cab or offer the service of transportation to the User. ReeCab also doesn’t act as an agent of any Taxi/Cab operator in the process of providing the above-mentioned technology platform services.

1.1.2. The Taxi/Cab ticket booking voucher which ReeCab issues to a user is solely based on the information provided or updated by the Counter / Syndicate or Taxi/Cab operator regarding the seat availability.

1.1.3. The amenities, services, routes, fares, schedule, Taxi/Cab type, seat availability and any other details pertaining to the Taxi/Cab service are provided by the respective Taxi/Cab operator and ReeCab has no control over such information provided by the Taxi/Cab operator.

1.2. LIMITATION OF LIABILITY OF REECAB

In its role as a technology platform to enable transactions between the Taxi/Cab operators and the Users, ReeCab shall not be responsible for the operations of the Taxi/Cab operator including, but not limited to the following:

1.2.1. Timely departure or arrival of the Taxi/Cab.

1.2.2. The conduct of Taxi/Cab operator's employees, representatives or agents.

1.2.3. The condition of the Taxi/Cab, seats etc. not being up to the customer's expectation or as per the description provided by the Taxi/Cab operator.

1.2.4. Cancellation of the trip due to any reasons.

1.2.5. Loss or damage of the baggage of the customer.

1.2.6. The Taxi/Cab operator changing a customer's seat for any reason whatsoever.

1.2.7. Taxi/Cab operator informing a wrong boarding point for the issuance of the booking confirmation voucher, or changing such boarding point eventually with or without any notification to ReeCab or to the User.

1.2.8. Taxi/Cab operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the Taxi/Cab.

1.3. RESPONSIBILITIES OF USERS

1.3.1. Users are advised to call the Counter/Syndicate or Taxi/Cab operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.

1.3.2. At the time of boarding the Taxi/Cab, users shall furnish a copy of the ticket, and any valid identity proof like aadhar card, passport, PAN card or voter identification card or any other identity proof issued by a government authority.

1.3.3. Users are required to reach the boarding place at least 30 minutes before the scheduled departure time.

1.3.4. All tickets issued shall be non-transferable.

1.4. CANCELLATION OF TICKET

Cancellation of tickets is subject to the following conditions and terms:

1.4.1. In order to cancel a ticket, at least one passenger from the booking must be waiting for a new ticket. If none of the passengers require a new ticket, the cancellation will not be processed.

1.4.2. The request for cancellation must be made by the primary ticket holder or the person who made the booking.

1.4.3. Cancellation requests can be submitted through our designated channels, including online platforms, customer service helpline, or authorized agents.

1.4.4. The cancellation request must include all necessary details, including the booking reference number, passenger names, and any other information required for identification and verification.

1.4.5. Cancellation charges may apply as per the fare rules and regulations of the ticket. These charges will be deducted from the refund amount, if applicable.

1.4.6. Refunds, if applicable, will be processed based on the original mode of payment used for purchasing the ticket. The refund amount will be subject to any deductions, including cancellation charges.

1.4.7. The cancellation policy may vary depending on the type of ticket, fare class, and specific terms and conditions set by the airline, travel agency, or other service providers.

1.4.8. It is the responsibility of the passengers to ensure they meet all requirements and conditions for cancellation, including providing accurate information and adhering to any deadlines specified by the service provider.

1.4.9. In case of any disputes or issues related to the cancellation policy, the decision of the service provider will be final and binding.

1.4.10. The service provider reserves the right to modify or update the cancellation policy at any time without prior notice. It is advisable for passengers to review the policy periodically to stay informed about any changes.

1.4.11. Please note that this is a general cancellation policy statement. Specific terms and conditions may vary depending on the service provider, booking platform, or ticket type. It is recommended to refer to the individual terms and conditions provided by the relevant service provider for detailed information regarding cancellations.

1.5. RESCHEDULING OF TICKET

1.5.1. Rescheduling (i.e. change of date of travel) of the tickets facility is not available yet. For further information you can reaching Counter / Syndicate or Taxi/Cab operator.

2. RIDE

2.1. ROLE OF REECAB

2.1.1. ReeCab only provides a technology platform that connects intending travelers with vehicle operators to hire an entire vehicle. It doesn’t operate any vehicle or offer the service of transportation to the User. Instead fulfillment of these bookings is done by operators who are empanelled with ReeCab. ReeCab also does not act as an agent of any Taxi or Cab operator in the process of providing the above-mentioned technology platform services.

2.1.2. The Vehicle booking details which ReeCab issues to a user is solely based on the information provided or updated by the Counter / Syndicate or Taxi operator.

2.1.3. The amenities, services, fares, routes, schedule, vehicle type and any other details pertaining to the transportation service are provided by the respective vehicle operator and ReeCab has no control over such information provided by the operator or fulfillment of the same.

2.2. LIMITATION OF LIABILITY OF REECAB

In its role as a technology platform to enable transactions between the vehicle operators and the Users, under no circumstances can ReeCab be held liable for failure on part of a service provider to provide the User with a particular vehicle, the standard of service or any insufficiency in the services or any other service related issues including, but not limited to the following:

2.2.1. Timely departure or arrival of the Taxi/Cab.

2.2.2. The conduct and uniform of operator's employees, representatives or agents.

2.2.3. The condition of the vehicle, seats etc. not being up to the customer's expectation or as per the description provided by the operator.

2.2.4. Absence of amenities/welcome kit as per the description provided at the time of booking.

2.2.5. Cancellation of the trip by the vehicle operator due to any reasons.

2.2.6. Loss or damage of the baggage of the customer.

2.2.7. If User chooses the name of the operator and the vehicle for booking, best effort shall be made to ensure that the same operator fulfils the booking and provides the matching vehicle as per User’s choice.

2.2.8. In cases of unavailability of the hired vehicle or where the vehicle breaks down during the journey, ReeCab may reach out to the concerned service provider to make arrangements for an alternate vehicle of a similar standard. Users may reach out to support@reecab.com for any assistance.

2.2.9. It is the sole liability of the vehicle operator to obtain all the relevant licenses, permits, etc to undertake the travel booked. In case of any cancellation of booking owing to absence of necessary licenses or permits by the vehicle operator, ReeCab shall not be liable in any manner.

2.3. RESPONSIBILITIES OF USERS

2.3.1. Users are advised to call the vehicle operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.

2.3.2. At the time of boarding the Taxi/Cab, Users shall furnish a copy of the confirmation booking ticket, and any valid identity proof issued by a government authority.

2.3.3. Users are advised to check the booking confirmation SMS or email and re-initiate a booking in case of incorrect details immediately. Any loss, consequences and damages for any delay that may be caused to the User due to this shall be borne by the User.

2.4. CANCELLATION OF BOOKING

Cancellation of tickets is subject to the following conditions and terms:

2.4.1. Cancellation of bookings can be done through the User’s login in the ReeCab mobile application.

2.4.2. Any cancellation is subject to such cancellation terms & conditions as mentioned in the above column 1.4.

2.5. PAYMENT FOR BOOKING AND ANY ADDITIONAL CHARGER

2.5.1. FULL PAYMENT: Payment maybe made in full amount to ReeCab during the booking. Such total booking amount includes the base fare, applicable taxes including GST as may be applicable as per local laws, and any additional booking fee, service fee or convenience fee charged by ReeCab.

2.5.2. PAY AT VEHICLE: Under this option the User has to pay certain part of the booking amount specified at the time of booking / in the booking confirmation voucher to ReeCab and the balance to the vehicle operator at the start or end of the trip.

2.5.3. Expenses like toll charges, permit charges, parking charges, entry fees, Service Tax & any other Government Tax as per Government guidelines are to be borne by the User and paid directly to the driver.

2.5.4. The excess Driver bata wherever applicable has to be paid directly to the driver.

2.5.5. User may opt for Insurance while booking. Such Insurance will be provided entirely by third party and ReeCab in no way will be a party to any such claims or concerns on the matter.

3. MISCELLANEOUS

3.1. The Taxi/Cab operator shall solely be liable for compliance with all laws including but not limited to the Motor Vehicle Act, its rules, applicable regulations, guidelines, or directions enacted or issued by the Central Government or relevant State Governments. Any prosecution arising out of the contravention of such laws, rules, regulations, or guidelines including directives on fare control from respective RTOs or directions including but not limited to fines or penalties shall be borne by the Taxi/Cab operator. The User agrees to take up any grievance resulting from the cancellation or any deficiency in services due to any action of the enforcement agencies arising with the Taxi/Cab operator.

3.2. User Agreement and Privacy Policy at ReeCab website shall apply. ReeCab will be entitled to reject any claim in case there is any Taxi/Cab misuse of the offer by the User or the cancellation/claim is not eligible under the proposal.

3.3. The terms and conditions shall be governed by the laws of India. Any dispute arising from or in relation to this offer shall be subject to the exclusive jurisdiction of competent courts in Siliguri, West Bengal.

3.4. The maximum liability of ReeCab in the event of any claim arising out of this offer shall not exceed the amount under the underlying transaction paid by the User.

3.5. ReeCab shall not be liable to pay for any indirect, punitive, special, incidental, or consequential damages arising out of or in connection with the offer.
